The petitioners applied for appointment on the post of Assistant Teacher in Primary School run by State of U.P., Basic� Shiksha Parishad pursuant to advertisement dated 30 November 2011. The petitioners� qualified� in� T.E.T. Examination 2011 (Primary Level).
It is contended by learned counsel for the petitioners that the petitioners could not appear for counseling at district Lalitpur though they were having merit, hence the present writ petition seeking a direction to the authorities at district Lalitpur to consider the petitioners' case for counseling.
Learned counsel for the respondents would submit that the counsellings are over and since the petitioners have not appeared, they cannot be given permission as it would amount to permitting all such candidates who could not appear for counseling on the particular date.
Considering the facts and circumstances of the case, I find no merit in the present petition.
The writ petition is accordingly, dismissed.
However, dismissal of writ petition shall not preclude the petitioners from appearing in future counseling, if it is so advertised.

The grievance of the applicant is that the opposite party-contemnor has willfully and deliberately flouted the order of the Writ Court dated 29.11.2010 passed in� Civil Misc. Writ Petition No. 57287 of 2006, copy of which order has been filed as annexure-3 to the affidavit accompanying this application whereby the writ Court had allowed the writ petition in terms of the judgment passed in writ petition no. 22141 of 2004 (Niranjan Singh vs. State of U.P.)� decided on 23.12.2009 and further held that in case seats are available for admission the respondents shall consider the case of those candidates who had passed B.Sc. Science (Agriculture) or B.Sc. Science (Home Science) treating them to be belonging the science stroam.
Learned counsel for the applicant contends� that against the aforesaid order The State has filed special appeal No. 759 of 2011 which was dismissed by the Division Bench of this Court vide order dated 29.7.2011, copy of which has been filed as Annexure-9 to the affidavit accompanying the application. It is further contended that even the State has filed Special Leave Petition which has also been dismissed by the Apex Court. It is next contended that order passed by the writ Court as well as by the division bench of this Court and also by the Apex Court, which were served upon the opposite party, the opposite party has sent letter dated 17.5.2014 to the Secretary U.P. Basic Shiksha Parishad, Allahabad for seeking direction.
Issue notice to opposite party returnable within four weeks, within which time he may file counter affidavit.� Steps be taken within a week.�
Rejoinder affidavit, if any, may be filed within two weeks thereafter.
List after the expiry of the aforesaid period.

Heard learned counsel for the petitioner and learned Chief Standing Counsel who has accepted notice on behalf of respondent nos. 1,3 and 4.� Sri M.M. Asthana, learned counsel has accepted notice on behalf of respondent no.6.
Learned counsel for the petitioner has placed reliance upon a similar order passed in W.P.No, 2239(M/S) of 2015 and has prayed that the writ petition may be disposed of in terms of the same order.
Learned Standing Counsel has no objection to the prayer made by learned counsel for the petitioner.
It is further submitted by learned counsel for the petitioner that the orders passed by this Court do not adjudicate upon the merit of respective candidates,therefore, it is quite likely that the merit of candidates in the process of counselling may stand affected.
Learned Standing Counsel in response to the above submission has stated that whenever conselling takes place, merit of the candidate shall not be compromised. That being the position, this writ petition is also disposed of in terms of the order dated 29.04.2015, which is reporduced below:-
"Sri. M.M. Asthana, learned counsel has accepted notice on behalf of respondent no.6. Sri Prashant Arora, learned counsel has accepted notice on behalf of respondent no.18. Notice on behalf of respondent no.19 has been accepted by Sri Rahul Shukla,learned counsel whereas Sri Jogendra Nath Verma, learned counsel has accepted notice on behalf of respondent nos.4, 20 to 22 and 24 to 28.
The petitioners claim benefit of an interim order dated 20.11.2014 passed in Writ Petition No. 7202 (M/S) of 2014 which is based on an order previously passed by this Court on 13.11.2013 in Writ-A No. 59978 of 2013. The dispute appears to have been set at rest by this Court in Special Appeal (Def) No. 716 of 2014 which has reaffirmed the decision taken by this Court in earlier Special Appeal (Def) No. 680 of 2014. It has been ruled by the Court that a candidate securing 82 marks shall be taken to be possessed of the minimum eligibility of 55% marks so far as reserved category candidates are concerned and this is now generally accepted in respect of the eligibility for TET also.
The respondents do not dispute that once the petitioners have obtained 82 marks, they shall be eligible and entitled to participate in the selection process. In this regard government order dated 02.01.2015 has been issued according to which provisional T.E.T certificate shall be the basis of consideration which can be obtained on being applied for before the Board giving particulars of the relevant T.E.T examination.
in view of above, benefit of order passed by this Court in similarly circumstanced cases is extended in terms of the order dated 16.02.2015 passed in Writ Petition No. 9334(M/S) of 2014 reproduced hereunder:-
"In view thereof, the writ petition is disposed of with the following directions:-
(1) The petitioner shall submit an application before respondent No.2 disclosing their Roll Numbers and marks obtained within two weeks alongwith certified copy of this order.
(2) In the event of such an application is moved, the respondent No.2 shall issue provisional certificate/marksheet on the basis of information available on the website within 15 days of the date of application.
(3) Learned counsel for the petitioner submits that though petitioner has not been able to participate in the counselling held on 6th and 7th February, 2014, however in the event of future counselling, the petitioner's claims should be considered by the respondents if the petitioner produces provisional mark-sheet of T.E.T. 2011 and they apprehend that they will not be allowed to participate in the counselling. In case, the petitioner submits provisional T.E.T. certificate pursuant to the order of this Court before respondent no.2, his candidature may be considered for future round of counselling, if any, held for the post of Assistant Teacher (Science and Mathematics) in upper primary school run by U.P. Basic Education Board against 29,000 vacancies advertised on 11.07.2013."
Writ petition stands disposed of in terms of direction quoted above."

The petitioner is B.Sc., B.Ed. and belongs to Other Backward Class category. The petitioner qualified the Central Teacher Eligibility Test (CTET) in July 2013 in pursuance to an advertisement dated 27 September 2014 published by second respondent, Joint Director of Education, Allahabad. The petitioner applied for appointment on the post of Assistant Teacher in L.T. Grade in the Government Inter College. She was issued counseling letter on 17 April 2015 calling her for counseling, petitioner appeared in the counseling on 23 April 2015 along with original certificates. The date of birth of the petitioner is recorded as second July 1993.
The contention of the learned counsel for the petitioner is that there is an apprehension that the first and second respondent would not consider the claim of the petitioner as a stand has been taken, though verbally, that the petitioner would complete 21 years on 2 July 2014.
I have perused the advertisement with the assistance of the learned counsel for the parties.
Clause 3 of the advertisement, provides that a person should be 21 years on 1 July 2014, accordingly, the petitioner would complete 21 years on 1 July 2014 and not on 2 July 2014 as is being alleged by the respondents.
Considering the facts and circumstances of the case, since it is not disputed that the petitioner's date of birth is 2 July 1993 and the eligibility as per the advertisement requires that the incumbent must have completed 21 years as on 1 July 2014, the petitioner would complete 21 years on 1st of July 2014, accordingly, she is eligible to be considered for appointment.
In such circumstances, it is provided that the respondents would treat the petitioner 21 years of age on 1 July 2014 and consider her case for appointment as Assistant Teacher L.T. Grade in the counseling as held on 23 April 2014.
Subject to the above, the writ petition is finally disposed of.
No costs.

दैवी आपदा से होने वाले नुकसान के सर्वे और रोजमर्रा के कामकाज के लिए सरकार जल्द ही लेखपालों की कमी दूर करने जा रही है। लेखपालों के पांच हजार पद और सृजित करने के साथ ही मौजूदा समय में खाली लगभग सात हजार पदों को भरने की प्रक्रिया शुरू की जा रही है।

मुख्य सचिव आलोक रंजन ने 12 हजार नए लेखपालों की भर्ती के लिए लिखित परीक्षा आयोजित कराने के निर्देश दिए हैं। उन्होंने कहा कि चयन प्रक्रिया में पूरी पारदर्शिता रखी जाए।

मुख्य सचिव सोमवार को राजस्व विभाग के कामकाज की समीक्षा कर रहे थे। उन्होंने कहा कि कानूनगो पद के लिए पहले से सृजित 2400 पदों के अलावा 1308 पदों की स्वीकृति तत्काल जारी की जाए।

साथियों,
आज सुप्रीम कोर्ट की कार्यवाही आपको पता लग चुकी है,शेष सविस्तार से ऑर्डर आने पर स्वतः सिद्ध होगा क्योंकि जो मैं अभी बता रहा हूँ उसे सुन आप हैरान होंगे,यथा -
चूँकि आज की सुनवायी की प्रेयर विपक्षी पक्ष ने की थी सो उसने नये विज्ञापन पर अदालत के बैठते ही बहाली का अनुरोध किया जिसे जस्टीस ने सिरे से नकार दिया,तब टीईटी मोर्चा के अधिवक्ताओं ने सरकार द्वारा फर्जी लोगों के खिलाफ कार्यवाही,उनसे रिक्त पदों को सही अभ्यर्थयों से भरने और चयनितो का डाटाका अनुरोध किया जिसे जजेस ने स्वीकार कर निर्देश दिये जो की ऑर्डर में सविस्तार पता लगेंगे !
चूँकि विपक्षी अधिवक्ताओं ने बड़ी आशा और कुटिलता से आखिरी दाँव चल फाइनल हियरिंग की प्रेयर की थी पर जब जजेस ने उनके तर्क और माँग सिरे से नकार दी तो उनके पास जजेस और अपने मुवक्किल को जवाब देने को कूछ बचा नहीँ था और अपनी करनी पर खीझ कर रह गये
और सुप्रीम कोर्ट से निकलते ही जब मीडीया ने उनसे सवाल किये तो वकीलों ने जजेस की उक्त बातों को भर्ती रद्द करने की मनगढ़ंत कहानी से जोड़ बताया,जिसे मीडीया ने और बढ़ा चढ़ा पेश किया जिसके आधार पर हमारे ही कूछ दुष्ट और कूछ नादान साथियों ने सबको तरह तरह से भयभीत करना शुरू कर दिया जो की पूर्णतः गलत,असत्य,मिथ्या और एक अक्षम्य अपराध है !
मित्रों, मैं उन वकीलों,मीडीयाकर्मी या पेनीक फैलाने वाले हमारे ही साथियों को चुनौती देता हूँ की यदि ऑर्डर में कोई भी भर्ती निरस्ती की कोई बात हुई तो मैं नौकरी छोड़ दूँगा और यदि न हुई तो ये सभी अपरोक्ष नक़ल माफिया के सदस्य पश्चाताप को तैयार रहें क्योंकि ऊपर वाली अदालत में देर हो सकती है अँधेर नहीँ !
जजेस ने फर्जी अभ्यर्थीयों पर कार्यवाही कर चयन निरस्त कर योग्य अभ्यर्थीयों को पद देने की बात की थी न की भर्ती निरस्त की !
गत चार वर्षों से ये भ्रष्ट तंत्र के साथी जिसमें कुटिल अधिवक्ता,पैड मीडीया,सरकार के लोग एक गेंग बना देश के कानून और भविष्य से खेलने में लगे हैं ! इनका अंत निकट और सुनिश्चत है !
ये बात जजेस भी जानते हैं की मुद्दा शासन द्वारा भर्ती को अवैध तरीके से रोक अपनी शक्ति के दुरुपयोग का है इसीलिए जज पुराने विज्ञापन के अभ्यर्थीयों के साथ खड़े दिखते हैं,हकिकत में वो सत्य और न्याय के साथ हैं !
भर्ती अक्षुण्ण सत्य और न्याय है जो ईश्वर प्रदत्त वरदान है,निश्चिंत हो नेकनीयती से कर्मपथ पर संगठन के साथ दुर्जनो का विनाश कर जीवन को जीवंत और गतिमान रखें,शेष फ़िर...

सुप्रीम कोर्ट ने यूपी सरकार को निर्देश दिया है कि गैरटीईटी पास लोगों को तुरंत प्रभाव से शिक्षक पद से हटाया जाए जो गैरकानूनी तरीके से भर्ती हो गए हैं। इसके साथ ही कोर्ट ने यूपी सरकार को आदेश दिया कि वह सभी उम्मीदवारों के नाम इंटरनेट पर डाले जिन्हें नियुक्त किया गया है। सरकार को इसके लिए तीन हफ्ते का समय दिया गया है। जस्टिस दीपक मिश्रा और यूयू ललित की पीठ ने मंगलवार को आदेश देते हुए इस मामले की अंतिम सुनवाई के लिए जुलाई की 6 और 13 तारीख तय की हैं। कोर्ट ने एक बार फिर स्पष्ट किया कि कोर्ट के आदेश पर भर्ती किए जा रहे शिक्षकों को नौकरी में कोई अधिकार नहीं मिलेगा उनकी नियुक्ति याचिकाओं के नतीजे पर निर्भर करेगी। कोर्टने यह आदेश एक याचिका पर दिया जिसमें आरोप लगाया गया था कि फर्जी तरीके से भर्तियां हो रही हैं और कई ऐसे लोग भर्ती हो गए हैं जो टीईटी पास नहीं हैं। सुनवाई के दौरान यूपी सरकार ने बताया कि अब तक 54,464 शिक्षकों ने नौकरी ज्वाइन कर ली है और भर्ती प्रक्रिया जारी है। कोर्ट ने 24 फरवरी को आदेश दिया था कि अखिलेश यादव सरकार सभी 72825 भर्तियां पूरी करे। तब से सरकार भर्तियां कर रही है। मामला भर्ती के निमयों में बदलाव का है। सरकार का कहना है कि भर्ती का आधार सिर्फ टीईटी ही नहीं होना चाहिए उसके लिए शैक्षणिक योग्यता भी देखनी चाहिए। उम्मीदवारों ने इस हाईकोर्ट में चुनौती दी थी उसके बाद गत वर्ष यह मामला सुप्रीम कोर्ट आ गया

नई दिल्ली । उत्तर प्रदेश में 72,825 प्राइमरी टीचर्स की भर्ती के संबंध में राज्य सरकार ने सुप्रीम कोर्ट में स्टेटस रिपोर्ट दाखिल की है। रिपोर्ट में सरकार ने जानकारी दी है कि अभी तक कुल 54,146 पदों पर भर्ती हो चुकी है। हालांकि इस भर्ती प्रक्रिया को लेकर सुप्रीम कोर्ट में सवाल उठाए गए।

आपत्ति जताते हुए एक वकील की ओर से कोर्ट में आरोप लगाया गया कि इनमे से करीब 20,000 टीचर ऐसे हैं जिन्हें गलत तरीके से भर्ती किया गया है। वकील का कहना था कि इस भर्ती की शर्त थी कि टीइटी पास अभ्यर्थियों को ही भर्ती किया जाएगा। लेकिन ऐसा नहीं हुआ है। इस पर कोर्ट ने संज्ञान लेते हुए कहा कि यह गंभीर मसला है और आपत्ति करने वाले इस बारे में एक हलफनामा दाखिल करें। कोर्ट ने कहा कि अगर ये नियुक्तियां गलत पायी गयी तो ये सभी भर्ती रद्द होंगी। सुप्रीम कोर्ट में अब इस मामले की अगली सुनवाई 6 जुलाई को होगी।

आज की सुनवाई का शारांश निम्न रहा :--

(1) सरकारी पक्ष ने महिलाओं के रिक्त पदों पर नियुक्ति हेतु निर्धारित मानक (70% टेट मार्क्स) में शिथिलता देकर 65% किये जाने की अपील की जिसे जस्टिस दीपक मिश्रा जी ने गुणवत्ता मानकों के विपरीत बताते हुए खारिज किया,,,

(2) टेट मोर्चे के अधिवक्ताओं ने चयनित अभ्यर्थियों का डाटा ऑनलाइन/फर्जीवाड़े के संदर्भ में पक्ष रखा जिसे जस्टिस मिश्रा जी ने एडाप्ट करते हुए सरकार को निर्देश जारी किये कि फर्जी पाये जाने वाले अभ्यर्थियों को बाहर कर उनकी सीटें अगले क्रम में प्रतीक्षारत अभ्यर्थी को दी जाय,,,इसके अतिरिक्त 4 सप्ताह में चयनित अभ्यर्थियों की सूची ऑनलाइन करके काउंटर एफिट-डेविट लगाने के भी निर्देश दिए गए,,,

(3) अकेडमिक पक्ष के वकीलों ने अकेडमिक अभ्यर्थियों को रिलीफ दिए जाने सम्बन्धी पक्ष रखना चाहा जिसे जज महोदय ने रोकते हुए कहा की मामला "रिलीफ" का नहीं बल्कि "जस्टिस & रूलिंग" का है, फिर भी फाइनल आर्डर में इसे देखेंगे,,अभी कुछ नहीं,,,,,,,,

(4) अगली सुनवाई की तारीख 06 जुलाई 2015 को नियत की गयी है किन्तु यदि किन्हीं तकनीकी/विधिक कारणों से 06 जुलाई को सुनवाई नहीं हो पाई तो इसे 13 जुलाई 2015 को सुना जाएगा,,,
